In Minnesota, when someone is injured in a car accident, no matter who is at fault, the injured party can recover from his or her own car insurance company up to $20,000.00 in medical expenses and $20,000.00 in lost wages (unless additional coverage is purchased, called “stacking”).  Compensation for other types of damages such as pain and suffering the loss of future earning capacity and future medical care can only be recovered if the injured party can establish one of the following, called No-Fault tort thresholds:

1. Permanent disfigurement, such as a scar
2. Medical bills over $4,000.00, excluding diagnostic x-rays
3. More than 60 days of disability, disability being defined as an inability to engage in substantially all of the person’s normal activities
4. Permanent injury
5. Death.

Don’t be fooled by glitzy advertising by Twin City lawyers that saturate the airwaves. The Twin City lawyer you see on your TV screen almost never will be the lawyer that actually handles your claim. You need an attorney who knows the area and the people who live here.
To properly represent someone injured in an auto collision, an attorney needs to listen carefully to his client so he can fully understand what affect the injury has had – not only on the client, but on his or her family as well.  It is for this reason that your attorney needs to be accessible at all times, including evenings and weekends.  Twin City law firms simply can not provide this service.
In addition to simply being available to personally visit with you, you will need to feel comfortable with the attorney you choose – simply put, you will need to like and trust him.  To make this decision, don’t rely on TV advertising; instead, spend a little time meeting with the one you may choose before making your mind up.
At the Will Mahler Law Firm in Rochester MN, we welcome the opportunity to explain, in a low stress, confidential and friendly setting, all the options available to you at no cost to you.
Please call; you’ll be happy you did!
